Rights & Responsibilities Of A Legal Guardian

While most often the caretaker is a close relative of the child, legal guardians are not required to be related to the child. In order to establish guardianship, you must file papers in court. You will be required to pay a filing fee when you file your petition stating your interest in obtaining guardianship. Next, you will file a letter of consent from the child’s parents. From here, the court will set up interviews and may order a home visit and background check.

Legal guardianship is advantageous for long-term care. It is a means of providing the same care and love that a parent may be unable to offer the child.

  • How Does Guardianship Differ From Adoption?

    Answer

    During the adoption process, the biological parents’ rights are terminated and the adoptive parents become the child’s legal parents. Unlike adoption, as the legal guardian of the child, you will not be required to terminate the child’s legal relationship to his or her parents. The birth parents of the child will still have the right and responsibility of support and visitation.

    Isabela Amie Garcia was born and raised in Mexico. Fulfilling her dream to play and win on the professional tennis tour, she traveled extensively throughout Latin America and the United States. After achieving her goals on tour she realized that her true calling was the law. She subsequently enrolled in the University of Texas at Austin and graduated with honors in the studies of philosophy and business. She then went on to excel at the University of Oxford where she studied International Tax Law, European Union Law and International Constitutional Law.

    She earned her Juris Doctorate at Southern Methodist University School of Law with emphasis on Sports Law, Corporate Law and International Law. Isabela’s internships included The Office of the Texas Attorney General, Honorable Carl Ginsberg of the 193rd Civil District Court in Dallas County, and Honorable Sam A. Lindsay of U.S. District Court in the Northern District of Texas. She also served under Marc J. Steinberg, Senior Associate Dean for Research and Professor of Law, researching SEC compliance issues. Ms. Garcia relates through personal experience to all cultural, ethnic and economic groups.
